1. Acceptance of Terms

By accessing or using our Site, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site.

2. Use of the Site

• Eligibility: You must be at least 18 years old to use our Site and purchase our products.

• Permitted Use: You may use the Site for lawful purposes and in accordance with these Terms.

• Prohibited Use: You agree not to use the Site:

  • To engage in any unlawful or fraudulent activity.

3. Products and Licensing

• Product Information: We provide custom applications (“Products”) which are detailed on our Site.

• Licenses: Upon purchase, you are granted a non-exclusive, non-transferable license to use the Product in accordance with the licensing terms provided with each Product.

• Third-Party Purchases: All purchases are processed through PayHip (“PayHip”), a third-party payment processor. By purchasing a Product, you agree to PayHip’s Terms of Service and Privacy Policy.

4. Payments and Refunds

• Payment Processing: All payments are handled by PayHip. We do not store or process your payment information.

• Refunds: Refund requests must be directed to PayHip. Please refer to PayHip’s refund policy for more information, however you risk a permanent ban from our services upon a refund.

5. Intellectual Property

• Ownership: All content, features, and functionality on the Site, including but not limited to text, graphics, logos, and software, are the exclusive property of the Company or its licensors.

• Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.

6. Disclaimer of Warranties

Your use of the Site and Products is at your sole risk. The Site and Products are provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Site or Products.

• Any unauthorized access to or use of our servers and/or any personal information stored therein.

• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Site by any third party.

SOFTWARE SPECIFIC TERMS OF SERVICE:

Please read the following terms and conditions carefully before installing or using this software. By using our Software, you acknowledge that you have read, understood, and agree to be bound by this License Agreement and the accompanying warranty.
1. General Terms and Conditions

This License Agreement is a legally binding contract between you ("Licensee") and AToolsX (the "Licensor") regarding your use of this software product (the "Software") for both commercial and non-commercial purposes.
1.1 License and Activation

    Single License Requirement:
  Each copy of the Software must be installed on a separate computer or client. When the Software is deployed in multi-user environments, licensing must correspond to the number of individual users. Each license assignment can only be transferred to a new user or computer system once every 30 days. The Licensee is identified by the corresponding Windows account name.

  Device Binding:
  Your activated license key is permanently bound to the device on which it is first activated. Consequently, you may only use the licensed Software on that designated device. Please ensure you select the final intended device at the time of installation as license keys may not be shared or transferred to another device.

  Online Activation:
  Online activation is mandatory to verify the legitimacy of the license and to ensure proper usage.

1.2 Tool Access

Upon activation of a valid license key, you will receive full access to all integrated tools:

  Model Editor
  SFX Editor
  World Editor

Note: The Software is available as an “all-in-one” package; there is no option to purchase access to individual tools separately.
1.3 Supported Platforms

    Device Architecture:
  The Software supports only x64 (64-bit) devices. Licensees operating on x86 (32-bit) systems should refrain from purchasing.

  Operating System Requirements:
  Only devices running Windows 10 or Windows 11 are supported. Other operating systems are not supported.

  Virtual Machines:
  For security reasons, any installation on virtual machines—including virtual servers—is prohibited. Repeated attempts to activate or install the Software in virtualized environments may result in a permanent ban from AToolsX services. Note that dedicated servers are permitted provided they comply with the licensing conditions.

1.4 Functionality and Support

    Continuous Operation:
  While every effort is made to ensure that all features of the Software operate correctly at all times, there may be occasions when specific features experience bugs, crashes, or unforeseen behavior. In such cases, please report the issue immediately so that corrective measures can be taken.

  Pre-Installation Requirement:
  To ensure optimal functionality and support, please install the classic version of ATools (if applicable) prior to the installation of AToolsX. Confirm that the classic version operates correctly to facilitate timely assistance with any installation issues.

2. Redistribution and Usage Restrictions
2.1 Prohibited Distribution

    Transfer Prohibition:
  Transferring or distributing the licensed Software—including sharing license keys—with third parties without explicit permission is strictly forbidden. All distribution rights remain exclusively with the Licensor, and any unauthorized sharing constitutes a legal infringement.

2.2 Licensed Developer Components

    Usage Guidelines:
  Certain developer components (e.g., ShellBrowser Components) included with the Software may be incorporated into your projects at no additional cost, provided that they are delivered in binary form without an individual license file or are statically linked in a manner that prevents decompilation. Creating or distributing derivative libraries based on these components is not permitted.

2.3 Reverse Engineering and Modification

    Restrictions:
  Reverse engineering, decompiling, modifying, or otherwise tampering with the Software in any form is strictly prohibited. Any violation of this provision will result in immediate and permanent revocation of access to AToolsX services.

3. Payment, License Duration, and Refund Policy
3.1 License Duration and Renewal

  Non-Subscription Model:
  The Software is licensed on a 30-day basis without automatic renewal. To continue using AToolsX beyond the expiration of your current license, a new purchase is required. This structure is in place to prevent any unintended automatic payments.

3.2 Refunds and Chargebacks

   Refund Policy:
  All sales are final. Refunds are not available under any circumstances. Initiating a chargeback—even if unsuccessful via your payment provider—will result in a permanent ban from all AToolsX services.

4. Updates and Support
4.1 Software Updates

   Update Provision:
  Following a successful purchase, updates and maintenance releases are provided free of charge. These updates typically do not reduce your active license period; however, please be aware that update downloads may be subject to network conditions, and the Software may be temporarily inaccessible during the update process.

  Activation Reminder:
  The 30-day license period begins only upon successful online activation of your license key.

5. Warranty Disclaimer and Limitations of Liability
5.1 Disclaimer of Warranties

   "As-Is" Basis:
  Despite comprehensive testing, the Software is provided "as is," without warranty of any kind. No guarantees are given regarding its merchantability or fitness for any particular purpose, nor is any performance or result from using the Software assured.

5.2 Limitation of Liability

   Liability Cap:
  AToolsX, its authors, and related parties shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the Software. This includes, but is not limited to, lost profits, lost savings, or any other economic loss.
